1. Electronic records and signatures
Before electronically accepting a consumer disclosure that law requires to be in writing, YourEMR will present an Electronic Records Consent that: describes the categories of records provided electronically; states whether consent applies to one transaction or the ongoing relationship; explains how to request a paper copy and whether any lawful fee applies; explains how to withdraw consent, when withdrawal becomes effective, and any effect on electronic-only features; explains how to update email or other contact information; identifies required hardware and software, including a device with internet access, a current browser, a working email address, and software capable of displaying and saving or printing HTML and PDF records; and requires an electronic action that reasonably demonstrates the person's ability to access the electronic record in the form used.
Consent to electronic records is separate from Paid Access purchase authorization, Consumer Health Data consent, Public Link consent, and optional marketing consent. Withdrawal does not invalidate records previously provided and may require YourEMR to use paper delivery or discontinue only a feature that cannot lawfully or reasonably operate without electronic records.
Paper-copy and withdrawal requests may be made through Account settings or support@youremr.net. Do not include health information, passwords, payment data, identity documents, or Public Links in ordinary email.
2. Transactional communications
Transactional communications may include verification, security, purchase receipts, optional courtesy repurchase reminders sent before a Paid Access term's expiration date, consistent with Document 02, which never initiate or authorize a charge on their own, state-specific notices, payment failures, refund confirmations, order and shipment status, policy changes, rights requests, retention-period-related account notices consistent with Document 05, incident notices, and service messages. They do not depend on marketing consent. Resend is the intended transactional-email provider.
3. Contact accuracy
Keep contact information current. Delivery failure does not authorize a new charge or indefinite Public Link, but legally sufficient notice may use permitted in-app, website, email, mail, or other methods.
4. Optional email marketing
Send me optional YourEMR news and offers by email. I can unsubscribe at any time. This choice does not affect my Account, Paid Access, privacy rights, or purchases.
5. Unsubscribe
YourEMR will honor an email marketing unsubscribe promptly and within 10 business days. A suppression record may be retained to prevent future marketing. Unsubscribe does not stop required transactional messages.
6. SMS and scan alerts
SMS marketing, recurring texts, and scan alerts are not authorized by this Policy. Do not collect or use SMS consent until counsel approves the feature, message categories, frequency, automated technology, STOP/HELP language, quiet hours, age rules, carrier requirements, state law, and evidence retention.
7. Breach-notice preference
If YourEMR relies on email for a notice under the FTC Health Breach Notification Rule, the enrollment flow must provide the required clear opportunity to choose first-class mail where applicable and support any required supplemental electronic notice.
8. Sender contact
Commercial email must identify YourEMR LLC and include YourEMR LLC, 2734 Beaver Run Blvd, Suite B #421, Surfside Beach, SC 29575. Questions and unsubscribe problems may be sent to support@youremr.net.
