YourEMR Physical Product Terms of Sale (QR and Optional NFC)

Separate personalized purchases, proof approval, production, scanning and tapping, and remedies

1. Approved products

YourEMR's sole launch physical product is a separate one-time purchase: an NFC/QR PVC card (SKU YEMR-NFCQR-CARD-01) at $7.99. The price displayed at checkout controls the transaction. The QR code and NFC chip both link only to the customer's chosen YourEMR URL and do not store Profile content. QR-only PVC cards, every magnet including 3-inch by 3-inch and 4-inch by 4-inch options, and key tags are deferred and are not orderable through the interface or server. Physical-product ordering remains disabled until YourEMR has selected, approved, and tested the production equipment, location or provider, packaging, data-handling process, and fulfillment workflow for the launch card. Once enabled, each approved product is produced and fulfilled by YourEMR directly or through a production arrangement YourEMR has approved and confirmed may lawfully be used for that purpose; no outside vendor currently receives customer order data, artwork, personalization content, or Profile content for any approved product, and if YourEMR later approves an outside production or fulfillment provider, that provider will be added to YourEMR's vendor register and this document will be updated before it receives any such data. The launch card is not required to use YourEMR's digital Account or Profile features.

2. Separate one-time purchases

Physical Products are separate, custom, one-time purchases. Product types are limited to the SKUs listed in Section 1 above and any later SKU formally added to this document. They are not included automatically with a Paid Access purchase and do not renew unless checkout expressly describes a separate bundle.

3. Personalized goods and customer information

Most Physical Products are personalized using customer-selected information. You are responsible for the accuracy, authority, and legality of names, Profile selection, spelling, visible fields, shipping information, QR destination and, for the QR-and-NFC card, NFC destination, and other content you approve.

4. Proof review and production authorization

Before production, YourEMR will display a proof or final preview. You must review the item, name, spelling, layout, color, QR destination and, for the QR-and-NFC card, NFC destination, visible information, and shipping address. Production begins only after you affirmatively check the production-approval control and select the clearly labeled authorization button. The control is unchecked by default. If the delivered product matches the approved proof, customer-approved errors are corrected or reprinted at the customer's expense.

5. Production and data handling

Every currently approved product is produced and fulfilled by YourEMR directly or through a production arrangement YourEMR has approved and confirmed may lawfully be used for that purpose. This document does not identify a specific facility, equipment manufacturer, or production provider, since that arrangement may change over time. No outside vendor currently receives your order data, artwork, QR or NFC information, personalization content, or shipping information. If YourEMR later approves an outside production or fulfillment provider, that provider will be added to YourEMR's vendor register and this document will be updated before it receives any such data. The QR code, and the NFC chip on the QR-and-NFC card, are encoded through a YourEMR-controlled process and link only to the destination you approved; the NFC chip does not store your name, medical information, Profile content, or other personal information, and functions only as a pointer to the same YourEMR web address as the QR code. On the QR-and-NFC card, the NFC chip is programmed with that same address, the programmed value is read back and compared against the expected address before the chip is permanently write-locked, and the write-lock is verified again afterward, so the chip cannot be reprogrammed once shipped. Production is operator-assisted: successful payment alone does not automatically trigger printing, NFC programming, postage purchase, or shipment, and a human operator manually reviews and authorizes each order before production begins. YourEMR will use post-delivery activation, delayed token binding, or another verified method that keeps the live Profile content from displaying through the QR code or NFC chip until you sign in after delivery and affirmatively activate it, described further in Section 8.

6. QR and NFC destination and link behavior

A QR code, or the NFC chip on the QR-and-NFC card, points to the destination selected for the order. If the associated Public Link is deactivated, rotated, suspended, or expired, the printed code or encoded NFC chip, where present, may no longer open the same content. A printed or encoded item does not guarantee permanent accessibility.

A physical product's QR code, and NFC chip where present, are permanently linked to a specific digital Account and Profile; it does not expire or stop functioning on its own simply because the underlying Paid Access term does. If the customer's Paid Access term expires, scanning the QR code or tapping an NFC chip continues to work exactly as any other access to that Profile's Public Link would: it displays the limited name-and-photograph view and inactive-profile notice described in Document 05 for the duration of the data-retention period, and stops resolving entirely once that retention period ends and the link is deactivated. Repurchasing restores full Public Link content through the same physical item without requiring a new QR code or NFC chip, where applicable, unless the existing one cannot safely be reused or the customer requests a replacement, consistent with Document 02.

7. Production cutoff and cancellation

At checkout, you authorize payment and acknowledge the disclosed custom-work cutoff. The order may be canceled for a full refund only until YourEMR begins preparing the proof. The cutoff must be a recorded order-status event disclosed at checkout and in the confirmation. After a proof exists, a separate production-approval step is required. Once proof preparation begins, the custom order is non-refundable for customer preference or change, and after production approval it is also non-refundable for customer-approved content. This does not limit remedies for YourEMR error, production defect, covered damage, nondelivery, unsuccessful replacement, or mandatory law.

8. Activation after delivery

Where post-delivery activation is used, the product will not display Profile information through the QR code or NFC chip, where present, until the Account holder signs in, verifies the intended Profile and final Emergency View, and affirmatively activates the destination. YourEMR will explain this step in the order confirmation and delivery instructions.

9. Price, tax, shipping, and timing

Checkout displays the product price, customization charges, tax, the flat $2.99 shipping and handling charge described in Document 07, and the supported production and shipping estimate. Shipping and delay rules are in Document 07. Physical-product refund and replacement rules are in Document 08.

10. Materials and tolerances

Products may use plastic, metal, adhesive, laminated, printed, or other stated materials. Minor variations in color, size, alignment, finish, or placement may occur and are not necessarily defects.

11. Scan, tap, and device limitations

QR performance varies with lighting, camera quality, software, internet access, surface wear, placement, bending, scratching, dirt, damage, and other conditions. For the QR-and-NFC card, NFC performance also depends on whether the reader's device includes an NFC chip and has NFC reading enabled, on chip placement and orientation relative to the reader, on case or wallet material, and on similar physical and device conditions. Not every phone or reader supports NFC, and NFC support varies by device model, operating system, and settings outside YourEMR's control. YourEMR does not guarantee scanning or tapping in every condition or on every device, and recommends that a customer who wants the most universally compatible option rely on the QR code, which works with any camera-equipped smartphone and is present on every product, rather than on NFC alone.

12. No medical-device or emergency guarantee

A Physical Product is not a medical device, emergency monitor, dispatch service, or medical identification guarantee. No responder, clinician, bystander, or caregiver is guaranteed to notice, scan, tap, understand, or use it.

13. Warranty and consumer rights

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHYSICAL PRODUCTS ARE PROVIDED "AS IS" EXCEPT FOR EXPRESS PRODUCT DESCRIPTIONS AND THE REMEDIES IN DOCUMENT 08. IMPLIED WARRANTIES ARE DISCLAIMED ONLY TO THE EXTENT LAWFULLY PERMITTED. NONWAIVABLE CONSUMER RIGHTS REMAIN.

14. Defective QR code or NFC chip

A QR code or, on the QR-and-NFC card, NFC chip that fails to function under ordinary supported conditions because of a production defect is a covered problem under Document 08 and is remedied by replacement, reprint, or refund as described there. A device-compatibility limitation described in Section 11, a Public Link the customer deactivated or rotated, or damage caused after delivery is not a production defect and is not covered on that basis, though other remedies in Document 08 may still apply depending on the cause.
